BAY MINETTE, Ala. — Testimony began Wednesday in the capital murder trial of Jared Smith Bracy, where friends and neighbors on the witness stand described a collective fear for the safety of the Smith family on Melanie Loop in Lake Forest.

The Arrest That Morning

That fear, witnesses testified, stemmed from the arrest of Smith Bracy earlier in the day on Feb. 22, 2023, for criminal mischief. One witness described the damage inside the house as looking like something an animal would have done.

A Drive-Through and a Quadruple Homicide

Shelia Glover and other church members urged Barbara Smith to leave the house before Jared got out of jail. She had agreed to do that, according to testimony, but needed to make sure her husband Leonard had something to eat.

In the time it took two friends to go through a drive-through at a nearby fast food restaurant and get back to the house, Barbara and Leonard Smith, Jared’s brother Jeremy Smith, and Shelia Glover had all been killed — bludgeoned and shot to death.

That detail, the interval of a fast-food run, is the testimony the jury will carry. It establishes both how narrow the window was and how immediate the danger had been understood to be by the people who had just left.

What Jurors Were Shown

Bodycam footage from responding officers showed jurors the conditions on the night of the murders and how investigators discovered the quadruple homicide, later arresting Smith Bracy near the backyard of the home.

Prosecutors also showed the T-shirt and shorts Smith Bracy was wearing the night of his arrest.

Body-worn camera footage has become central to how violent-crime trials are presented. It places jurors at the scene as officers found it, before anything was moved, and it is difficult for either side to characterize away.

Two Competing Accounts

Prosecutors called this a cold-blooded murder in opening statements.

The defense told jurors Smith Bracy was suffering from undiagnosed schizophrenia at the time of the murders and should be found not guilty by reason of mental disease or defect.

How Alabama Handles an Insanity Defense

The defense being raised is narrow and rarely successful, and it is worth understanding what it actually requires.

Under Alabama Code § 13A-3-1, a defendant may be found not guilty by reason of mental disease or defect only if, at the time of the offense, a severe mental disease or defect rendered him unable to appreciate the nature and quality or wrongfulness of his acts. The burden is on the defense, and the standard is clear and convincing evidence — higher than the preponderance standard used in most civil matters.

Critically, the statute specifies that mental disease or defect does not otherwise constitute a defense. A diagnosis alone is not sufficient; the defense must connect the condition to an inability to appreciate wrongfulness at the moment of the offense.

A successful verdict on those grounds does not result in release. A defendant found not guilty by reason of mental disease or defect in Alabama is committed to the custody of the Department of Mental Health for evaluation, and confinement can extend indefinitely subject to periodic review.

Capital Murder in Alabama

Capital murder is charged where a killing is accompanied by one of the aggravating circumstances enumerated in Alabama Code § 13A-5-40. The killing of two or more people by one act or pursuant to one scheme or course of conduct is among them.

A capital conviction carries either death or life imprisonment without the possibility of parole, determined in a separate sentencing phase following a guilty verdict.

What Comes Next

The trial continued Thursday with crime scene footage that the prosecutor described as some of the worst she has seen in her career. Prosecutors expect to wrap up their case early next week, after which the defense will present.

Smith Bracy is presumed innocent unless and until proven guilty, and no verdict has been reached.
