A Theodore man is facing DUI and drug charges after Mobile Police Department officers pulled over his vehicle in downtown Mobile last week, according to an MPD news release.
Officers stopped the vehicle near the intersection of Water Street and St. Joseph Street around 1:15 p.m. on Friday, Aug. 15. During the stop, officers allege they found drugs inside the vehicle. The driver, 55-year-old Anthony Boggs, was subsequently taken into custody.
Boggs is charged with DUI, possession of a controlled substance, and second-degree possession of marijuana. As with any arrest, the charges against Boggs are accusations, and he is presumed innocent unless and until proven guilty in court.
MPD has not released additional details about the traffic stop, including what prompted officers to pull the vehicle over.
About the Charges
Alabama’s DUI law applies to driving under the influence of alcohol, controlled substances or a combination of them. Under state law, possession of a controlled substance is generally a Class D felony, while second-degree marijuana possession, which covers possession for personal use, is a Class A misdemeanor.
