A new legal challenge to Republican gubernatorial nominee Tommy Tuberville’s residency has been filed in Jefferson County Circuit Court, marking the latest attempt to question where the former U.S. senator legally resides.
Ken McFeeters, who has previously challenged Tuberville’s residency, is suing him again, this time in Jefferson County, after a Montgomery Circuit Court dismissed a quo warranto action he had filed there. A quo warranto action is a legal proceeding used to challenge a person’s right to hold or run for public office.
The case is unfolding as a pro se lawsuit, meaning McFeeters is representing himself without an attorney, and it faces procedural hurdles as ballot certification deadlines approach. Under Alabama election law, those deadlines make an expedited ruling from the court essential if the challenge is to have any effect on the race.
